El Sobrante, CA asked in Native American Law for California

Q: I was notified I was fired from my position at Tribal TANF program for whistleblowing, while on bereavement leave.

I am a director of a Tribal TANF program. Two days ago, a council meeting happened to discuss how to terminate me. ( I will disclose the detail offline) I also am aware of that at least two of the Council members, and the Deputy Director met before the meeting to attempt to use this information to overthrow the Tribal Chair and to humiliate me publicly to stop me from disclosing how the Council had misused funds, sexually harassed employees, and block employment opportunity for tribal members. ( June elections) The Deputy Director and two Council members knew I had proof that their family members committed fraud to block a tribal member from getting cash aide. They also knew the executive director permitted me to investigate, and I had submitted the form to welfare fraud. ( There is additional back story leading up to these events)

A: I am sorry to hear about your situation. Unfortunately, the laws of California and the federal government likely will not apply to your situation. Rather, the laws of the tribal nation where the business is located would be those that will apply to you, and only someone with specific knowledge of the tribal laws can assist you. It is not going to be easy but you will need to find an attorney who knows the laws of that particular tribal nation to give you the answers that you need.

Good luck to you.
