Houston, TX asked in Criminal Law for Texas

Q: I got a public intoxication ticket in Dallas in April and received deferred disposition (7/30/19).

Do I still need to petition the court to remove, or expunge, the event off my criminal record once the case is dismissed?

A: Although class c tickets are harder to find, it is a good idea to expunge those. Yes, you do need to petition the court to expunge the record.

A: All background check companies have DPS data but only some of them have data from municipal or JP courts.

The records won't go away on its own but there is a chance that the court won't report it to Texas DPS.

All data spreads "in the wild" and the longer it is out there the more it multiplies so the best practice is to expunge it as soon as you are eligible to do so.
