Q: Me and my daughter's father have a court order for him to have her on the weekends. At what age can she decide not to go
A:
There is no such age in Arizona when a child simply gets to choose. However, the Judge IS required to consider the child's desires, but this is only one factor of many. I often stress to my clients that we not only need to show the Judge what the child wants, but (perhaps more importantly) also what is happening at the other parent's house, or between the parent and child, that is causing this opinion.
Please come in soon. We can certainly help you consider and then pursue your options for modifying your current Orders. This is obviously a very important matter, and you should not go in alone.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free ½ hour consultations, in which we can discuss your matter in detail.
Please call or email my assistant Maddy to schedule your free ½ hour consultation.
