Saint Marys, PA asked in Traffic Tickets for Pennsylvania

Q: My son got a ticket immediately after pulling onto a road for not having his headlights on. Can we fight this?

My son just turned 17 and got a used vehicle that does not have day time running lamps. Having learned to drive on a more recent model, he is trying to get used to turning headlights on and off. He was out at night for the first time playing a pick up basketball game at our local community courts. The second he pulled out of the parking lot a state cop pulled him over because he accidentally pulled out the light switch to parking lights rather than full headlights. He received a traffic citation in the amount of $142.50. The citation charges him with "General Lighting requirements" and the nature of the offense states "operating a vehicle on a highway with no head light system as required." In the confidential section of the ticket it indicates that "only his parking lights were active." We don't know if he will receive points on his license for this, or if he should fight it. It technically happened, but just seems extreme considering the circumstances. Any suggestions?

A: Plead not guilty. He was in the process of putting them on, did not have the intent to drive without them. See what happens.
