Q: Unwed father. a 7yo daughter. Have her min 149 overnight stays. Paternity established. Want to gain legal/physical cust

Oversaw and managed entire enrollment for school, coordinate majority of medical/dental visits. Pay for at least half sometimes all of extracurricular activities. Communicate respectfully and consistently with mother about co parenting topics only to be ignored or disregarded constantly. I am independent, i have a stable income and lifestyle while the mother does not. Still lives at home with mother, irregular work schedule, inconsistent income, emotionally unstable, and new boyfriend is extremely problematic/confrontational. Would like to think their is some neglect involved for the simple fact we cannot communicate appropriately about topics pertaining to my child’s growth and development personally/academically. I want to gain legal and physical custody. If and when I go to court, my only fear is child support. I have not physically handed her any money since my daughters early years. I intentionally spend more time with my daughter to replace paying a check. What does judge say

A: If you are truly concerned about your child's welfare you should petition the court for a majority of the parenting time and sole decision making. That is a major concern if the mother is emotionally unstable and her new boyfriend has problems and is confrontational. Child support should not be your primary focus. Do what is best for your child.
