Asked in Criminal Law and Domestic Violence for Illinois

Q: Do I have any grounds to get my case dismissed?

On November 13. 2018 I was involved in a domestic situation. The police were called and I made my report. The next day (November 14 2018) I went and got a order of protection that was granted. That same day the other party involved went and made a report on me and had a friend that sat In the car be a witness and gave a statement. I then called the police again to report a violation of the order of protection. The state would not go thru with charges since it didn’t involve violence. I then got a call from the police department weeks later saying the state of IL wouldn’t go thru with charges for the domestic. On February 11th. 2019. I ran my name and see I had a arrest warrant issued on Feb. 1st 2019 from the November 13th domestic issue. I turned myself in February 11th 2019 and I and still fighting the case. I want to know if I have any grounds to get the case dismissed? How can I prove my innocences? Does the state even have a case if the party involved doesn’t come to court?
