I'm a contractor in Colorado. I have a previous customer that contacted me about doing another building for them. I gave them a price. They proptley wrote out a deposit check. I met up with them to sign the contract and take the check. When I got to their residents they wanted to add more to the building. They gave me the deposit check to hold their spot in my schedule. I figured the extra cost of the addintional work and gave them the price, and got a new contract written up. Didn't hear back for a couple of weeks. Then got a text message saying they got another bid, were going with another builder, and wanted their deposit check back. Since I had their deposit check I had to turn away another job that would of made me about six times what their building would. That do to the time frame required I couldn't do that job.

A: Unless you are able to PROVE you lost out on the second job the people who are going to sue you will probably win. So, unless their deposit was HUGE, you would be smarter to refund it than spend it on defense lawyers.
