Q: Im frustrated with this probate. I have no choice but to try sooo can someone explain probate code 850 and 859 pls....

I can't afford to pay another retainer fee. I paid $8500 to a lawyer for him to file an 850 petition to quiet title. Time went by and turns out he never filed it but said he did....ahh! deceptive and misleading probate lawyer :( Now I am attempting to do this on my own and with lots of help from Justia. Can't be so bad since there's only cash from sale of house in this estate and only one heir and myself (i don't think heir will fight me much).

House did not legally belong to decedant. There was fraud change of title recorded. I want to correct the chain of title and name plantiff the sole owner at time the house sold and i want to charge for damages but who do i charge? (home was sold by Trustee sale foreclosure generating Surplus Funds). I allege heir who started this probate did the illegal title change in his attempt to inherit something by any means and with no regard as to the damage his acts would cause. Tying up my money in probate has had substantial financial harm.

if you retained him and he did not do his job ask for a refund and contact the state bar
