Q: Best interest of the child in the court eyes.

My ex moved closer to me in order to obtain residential custody and decision making. Currently our children are living with me due to my ex relocating our children out of state without permission. My ex recently quit their job and amended their response to they want equal shared time and no child support. My concern is that my ex will try to relocate the children if given shared parenting time. My ex was found in contempt of relocating our children out of state, but attempted 2 other times, involved them in unnecessary matters of the moves which caused a tremendous amount of stress on the children and I don't want them to go through that again. My ex has quit their job for the 4th or 5th time in 3 years with no job lined up. My ex is high conflict and is always telling the children that I don't provide or care for them. I don't think this is the type of behavior children should be around more of but will a court see it that way?

A: From what you have alleged, I do not believe the court will change Residential custody and decision making. Your former spouse has a history of not obeying court orders and the court will not take that lightly. If your former spouse voluntarily quit his or her job, the court can still enforce the current court order and deny a modification of it.
