Q: If a man is charged with domestic violence and it is his first offense will there be jail time?

A: Depends on if its First, Second or Third degree; depends on the facts and allegations; depends on the accused person's background and their personal circumstances. There are a number of factors that need to be considered. However, the accused person should consider putting themselves in the best possible position to avoid a jail sentence. Perhaps voluntarily enrol in a counselling program; perform some community service. On a second offence for domestic violence, there are minimum sentences, but no minimum or mandatory jail sentences for a first offence.
