Q: Can the federal government be sued for shooting at my son

He came to pick up his cousin at a hotel who was involved in a drug transaction unbeknownst to him. He saw police swarming in and took off they shot at him putting 4 bullets in his truck. Because they shouldn't have done it they are putting him in a drug conspiracy & claiming he tried to run them down. They have film of him driving up but not leaving conveniently. Since then they are willing to charge him with the misdemeanor attempt to assault a federal officer. My main question is can I as his mother sue them he's 32 with a child. He's still incarcerated on the drug conspiracy charge.
