Pearl River, LA asked in Adoption, Child Custody and Child Support for Louisiana

Q: Can my husband adopt my daughter, if her biological father has not paid child support in 6 months consecutively?

My child's father is wishy washy. He is a dad when it's convenient and its hard to get state mandated child support from him. He said he would not sign the papers for my husband to adopt my child, because it would make him look like a dead beat dad. He sees her occasionally. Lives on his parents couch and has since she was very very young. How would I go about this process? Is it even possible? Im just tired of fighting someone who does not have the childs best intrest in mind.

A: It sounds like it's time for an intrafamily adoption. You don't need bio dad's permission. Hire an adoption attorney.

A: Yes, the father's consent is not required if he's failed to comply with a court order of support for over 6 months or has failed to communicate with her in that length of time. I'd be happy to discuss the process further and potential costs if you'd like to give me a call.
