Q: Would it be a complication with my husband adopting my youngest child?

My son is from a previous marriage, his biological dad and I got divorced in Illinois when he was only 1year and 8 months, His biological father at the time of the divorce I only had one addressed where I sent out the divorce paperwork and that was in California, he signed the divorce and also a relocation petition I made for me to be able to move to Tx. He had a lawyer but never presented himself in court. The Judge gave me sole custody of my son. His Biological father never had paid child support, and we lost completely track of him, the last phone number I had was the line he had with me, we tried looking for. Last thing I knew after the divorce left to Mexico. It's been over 2 years we haven't heard from him or no one has seen him since then. Is there any complication where my husband can adopt him? He has been taking care of him financially, and physically. My husband has been the responsible party of my son since sept 2017.
