Saint Paul, MN asked in Criminal Law, Divorce, Family Law and Child Custody for Minnesota

Q: My wife's narcissistic "Christian" mother and father have brainwashed her into getting HRO, Ex Parte Custody and Jail 4

I am a 31-year-old Christian, father, husband, and founder of Krew Cleaning services. I had17 "violations of harassment order" that coincidently got filed against the morning I was supposed to see my daughters the first time in 2 months (due to an ex parte custody that got approved based on her saying she was scared I would flee with the kids....which was never implied, suggested or conceivable. I was told to keep the girls until my wife did a mental health eval and chemical assessment). Her parents proceeded to instruct her to get a restraining order on me...which she got denied. The girls came over I noticed a very bad diaper rash I sent her a picture. THAT WAS THE MOMENT EVERYTHING CHANGED. She 1.got an HRO (based on lies) 2.filed for divorce 3.Ex Parte and is doing it all "so I can't see the girls". How do I go about filing a motion to reconsider the ex parte and order forensic psychologist eval? Her parents are cult leaders and have isolated her and are controlling her. Im worried

A: You are entitled to a hearing on the HRO/OFP. There are instructions in the paperwork that you were served about how to request a hearing. It will be her burden at the hearing to establish that you have been harassing her or that an act of domestic abuse occurred. The violations are criminal offenses and you will need an attorney for those. You would need to hire a family law attorney to address the custody issue.
