Q: can my daughter( a minor) be charged with conspiracy to commit a crime, if I have proof that wasnt her intent.

i have text messages from one of the persons listed as a co conspirator, asking my daughter to go out and eat..when she showed up they trashed a building and then were questioned by police. She went out thinking she was going to dinner not breaking into a building. plz help

A: She can be charged if there was probable cause can be charged. If you have information that can form a defense hire a lawyer to advocate on her behalf.

A: Yes she can be charged it will be up to the prosecutor to prove knowledge or intent. That being said knowledge in regards to a court case is not actual knowledge but what the person knew or should have known thus it is not that hard for the state to generally prove a conspiracy. Get your daughter a good lawyer it's the only defense that she has and without one a charge can

turn into a conviction.
