A: Disorderly conduct change be charged as either a felony or misdemeanor. It is a felony if someone recklessly handles, displays or discharges a deadly weapon or dangerous instrument. If not, it is a class 1 misdemeanor with a potential for 6 months in jail and probation. If this truly is your first ever offense, you may be eligible for a diversion program that once completed will result in your charges being dismissed. You need to ask the state if you are eligible for this program. If you are not eligible or they will not offer it, you may want to consider hiring an attorney. Jail is unlikely for a first time offense but it is possible. I suggest speaking with an attorney to get more information specifically tailored to your situation.
