Q: My son is getting a divorce from his common law ex. They have 3 kids together. The kids have lived with him for 2 years
While waiting on the divorce process. She is now 6 months pregnant by someone else while they are still legally married. She quit her job as she is expecting twins. Will she still be ordered to pay child support and provide health insurance in Texas with newborns and no job?
A: She can still be ordered to pay child support whether she has a job or not. Typically when a person doesn't have a job the support is based on a 40 hour work week at minimum wage. Your son will have to wait until after she has the babies before finalizing the divorce and even then there are a few things that need to be addressed.
