Baton Rouge, LA asked in Child Custody, Child Support and Family Law for Louisiana

Q: Paid support from birth to 3yr but am not on birth certificate. Ex refuses to let me see or talk to son. What do I do?

I have been a part of my sons life from the beginning, I was there when he was born but didn't sign the certificate because I wasn't sure. Had DNA test done on my own and he's mine. I pay support when I'm working, I do industrial electrical so I get lay offs and down time between projects. I overpay when I work though to balance it out. I have a great relationship with my son but his mother and I split up a few months ago and she absolutely refuses to let me see him or even Skype with him now. They have always been a package deal. She hasn't worked in years and never let me have time with him without her. She refuses to sign an affidavit to acknowledge paternity, even though she has seen the results from the test I had done and takes money from me for child support. Shes determined to drag this out as long as possible and won't let me see him in the mean time. My question, if she has taken money from me for child support can she now contest paternity? Can I sue her for support paid?

A: You can hire a custody lawyer to file for filiation and joint custody. Then if she refuses you time with your child, you can hold her in contempt. This will also get you added to the birth certificate.
