South Bend, IN asked in Criminal Law and Federal Crimes for Indiana

Q: I would like to know if I have a case on my hands. I was arrested for Auto Theft in Sep. 17, 2019 between 5-6pm.

I was told I was in video with my boyfriend and another male commuting this crime. The detective who file for the warrant came to my house previously and I told him I did not do this crime and I was willing to give any evidence to prove this to be true I had an alibi. The detective accused me of lying and then proceeded to get a warrant for my arrest on this crime with no substantial evidence. I was arrested in St. Joseph County, where I reside, and was incarcerated in their county jail until the following morning, when I was transferred to Marshall County Jail for my alleged charges. I was held in a holding cell in my same clothing for over 50 hours with no shower or even a bar of soap. During my interrogation I was still accused of lying and of being the person in the video when I could prove I never been there. My bond for this crime was set at 10,005 dollars for a F(6). I just want to know if I have a case because I don’t see how a warrant was issued for my arrest in this case.

A: If you are convicted by plea or trial you have no case.

I think you should concentrate on your case before you consider a civil suit

A: You need an experienced criminal defense lawyer. If you were questioned by police, you more than likely made incriminating statements that will be held against you.
