Q: Who do you contact if the trustee won't communicate?

I appreciate your time and information, Mr Gaffney, thank you. I assume my brother is sole trustee. We have no relationship. I have gotten no response from mail or phone to my mother (I live in Kentucky, she lives in California). I have done a wellness check through the police. I have reported it to Adult Protective Services within their criteria of isolating a senior, since other family members are unable to check on her as well. I am awaiting their report. The police told me that my brother is her full-time caregiver. The only copy of the trust that I have has the name and address of the trust company, and a copy of an application for real estate record with document number, listing my father's name only and my parents house address. Would LA County Clerk have copies of the trusts? Thank you again for your time.

A: It is VERY unusual for any agency to have a copy of a trust. it is possible so you can check with the LA County Recorder's office, it is just never really done. The Trust company would be a better bet.

Are you worried that your brother is mistreating your mother? That will be a tough problem if he is, since it sounds like no one else is around. If APS finds a problem, they will work to fix it. You can get a restraining order if he is abusing her, but then who will take care of her?
