Q: How long can you be held in jail with no case

Had a family member go to the courthouse look up case number to see if there was any charges filed and the courthouse said they did not have anything as of October 15 and I have been in jail since September 27

A: Has this person been arraigned and informed what charges he/she was arrested for? Was this person arrested for an alleged felony or misdemeanor? Has a bond been set? Call an attorney. Good luck.

A: The people working in the clerk's office at the courthouse are not allowed to give "legal advice." Unfortunately, many of them don't really understand what "legal advice" really means so they just take everything literally and avoid offering suggestions or being helpful in any way whatsoever. When you asked about the "charge" they probably assumed you mean a formal document that is saved in the court's file... specifically either an "Indictment" from a grand jury or a document called an "Information" filed by the prosecutor. So the response you got was technically accurate, but not helpful. If you are just trying to get the person out of jail then you really need BOND information. A good starting point would be a consultation with a local criminal defense attorney.
