Q: is it kidnapping if I have legal right to my child

Recently enrolled him out of school to transfer to my location have all his information and the mother isn’t on any of his school records his aunt is my child said he doesn’t want to go back to the school because he was being bullied and mother is unfit to take care of him said his stepdad beat him with a belt and left a bruise mom didn’t do anything about it. I was sending money to aunt because mom used it for drugs have proof from aunt saying it just trying to figure out what actions can I take I recently filed child support on her
