Findlay, OH asked in Criminal Law for Texas

Q: 2 class a misdemeanor assault with body injury charges (lip and eyebrow) first offense. Will person see jail time?

No stitches or medical care needed. As of right now victims not pressing charges. Will this go to court? Since it’s first time offense will they see jail time?

A: This question is in the Texas forum but it says the person is asking from Ohio. This answer is based on Texas law. If the incident did not occur in Texas then nothing below applies and you need to re-post the question in the Ohio forum instead.

The minimum punishment is NOTHING since the cases could be dismissed. If it is handled as a pair of class A misdemeanors the maximum punishment is 1 year in the county jail and a $4,000 fine... chances are high that the time would be served concurrently rather than consecutively. HOWEVER, if these are alleged to be different instances then it is possible it could be charged as Continuous Family Violence which is a felony of the third degree punishable by 2 to 10 years in the state penitentiary and a fine up to $10,000. You need to hire the best criminal defense attorney available who takes cases in the county where the charges are pending.
