Q: What constitutes child neglect in Texas, or would I have a good chance of gaining joint custody with the examples listed

My children’s mother has consistently founds ways to use our kids against me, because I won’t be with her. She also does the minimum to care for them, and I find I am having to do all the “not fun” parenting when I have them during my time. I am wondering what my chances are of getting joint custody. I have listed some examples below that she has said, done, or not done as a parent should:

-Told our kids multiple times their daddy (me) doesn’t love them because he won’t get back with their mommy and make their family work. That I’d rather spend time with my girlfriend of 4 years and her daughter, than them.

-Consistently talks to the kids about mine and her “issues” when they should be allowed to be the kids they are, not brought into their parents problems. Keep in mind their 4, 7, & 9.

-Doesn’t demonstrate good hygiene practices with them, i.e. they’ll come over when it’s my time to have them, wearing the same clothes they were wearing 2 days ago when I saw them, not bathed,

A: You have valid concerns and if it has been more than 1 year since the last order then you sound like you have grounds for a modification. The court will have to determine if it is in the best interest of the child. We agree with you that children should not be in the middle of conflict and chaos. Best of luck. 888-343-4529.
