Q: What's needed to request a parents medical records and permission to be notified in PR if spouse is Health Care Proxy.

My wifes father is in Hospice (because doctors decided to stop treatment) in the VA in San Juan, PR. He lives there and we live in New York but currently down in PR. His wife, not our parent is the health care proxy and is trying to shut out his 3 daughters. She even filed a complaint at the hospital to try and keep them from seeing him. The daughters are seeking what they need to do, have father sign, etc... to allow them the same rights as her to be notified of his condition and to gain his medical records to be able to send to doctors in NY. One of Daughters is a NY Attorney. Please advise.

A: Hello and thank you for using JUSTIA. In order for anyone to get the récords of a veteran, you need written authorization from said veteran. The document needed is found at the following link;

This Will allow you to receive his past récords.

In order to request future récords you Will need to file with Veterans Affairs Office a written authorization signed by your Father. The following is an example of said document to be registered;

"I authorize the National Personnel Records Center, or other custodian of my military service record, to release to (your name) the following information and/or copies of documents from my military service record...." Include in the authorization all the information and/or document(s) you wish to receive. Make sure that your Father signs and dates the authorization. Authorizations are valid for one year from the date of signature. All documents for release of récords should be mailed to;

National Personnel Records Center

You can also personally deliver said authorization directly to Office room 1E112 at the Veterans Hospital in San Juan, P.R.
