You have this posted in medical malpractice, until you have a second medical opinion, you aren't going to have any basis to know whether there was any malpractice at all. Doctors cannot guarantee perfect outcomes or perfect performance, but they do have to meet the standard of care of a professional in their area of expertise. You should act quickly, however, the statute medical malpractice is only one year from discovery.
