Q: Which parent is responsible for the drop off and pick up of a child with Texas custody agreement during visitation?

Our custody papers state that during the non-custodial parent’s visitation, the non-custodial parent is responsible for the pick up and drop off of the child(ren) from and back to the custodial parent’s domicile, UNLESS the custodial parents county of domicile changes to a different county after the rendition of the custody order, THEN the non-custodial parent is responsible for the pick up of the child(ren) from the custodial parent’s domicile and the custodial parent is responsible for the pick up of the child(ren) from the non-custodial parents domicile, once the visitation time is complete. In my case, the custodial parent’s county of domicile has recently changed, and the way I read the papers is that I (non-custodial parent) am responsible for picking up my children when my visitation begins, and now that the mother’s (custodial parent) county of domicile has changed, she is responsible for picking them up from my residence when my visitation ends. Am I reading that correctly?

A: If you want a definite answer to your question, you need to make an appointment with an attorney and let them read your order. If you do not follow it correctly then you could be held in contempt of court. Orders can be different although there are standard orders. But, all people do not have to have the standard order in all cases. Have peace of mind and get it reviewed and all of your questions answered. Good luck.
