Orlando, FL asked in Family Law and Child Custody for Florida

Q: I have a 4 yo daughter, my ex moved to another state and his driver license has been suspended here..

...for financial responsbility and as far as I know, he doesn't have a new one from the state he moved to.

We don't have an open case or anything, but I normally let him see her during supervised visits and even stay overnight with her in my house.

Lately, he wants to force me to allow him unsupervised visits and suggesting taking her out on his car, even thought his dirver's license is still suspended and besides that, he wants to come to my house during late hours to see her and also call her out of the scheduled time we previously "verbally" agreed

What are my options? Do I have to allow him to take mi daughter with him under these circumstances? (No court order, Suspended Driver's license). Do I have to let him to come to my house after 9pm an call her out of schedule?

Thank you!

A: As an unwed mother, you actually have full guardianship of the child and do not have to "allow" any contact that is not court ordered. Therefore, although we always recommend working things out with the other parent, you should not allow the father to dictate the terms of how he will see the child as you must both agree to those terms or ask the court to assist in creating a parenting plan and timesharing schedule.

Good luck.
