The Villages, FL asked in Employment Law for Florida

Q: Do I have a case? Work Vehicle Hazard.

I have a work vehicle that had to be taken into a mechanic because it wouldn't start. The mechanic told me he's warned the owner on countless times because the airbags are broken and won't deploy. The alignment is messed up, the vehicle is too heavy for the small tires that's on it. This is the vehicle he's given me to use and I have no others. I cannot use my own vehicle because this is a pest control one where it's got liquid and equipment on it. I'm required to show up for meetings, not get paid and then get docked pay if I don't attend. I'm charged 3% off my pay if a customer uses a credit card to pay for the service. Given a draw twice a month no matter how many days are in the month for the same amount. I want to know if I have a case.

Company has around 50 workers. I don't know what kind of company it is, whether it's mom & pop or corporation. I live in Florida and I'm mostly worried about being forced to use a company vehicle that's so dangerous.

A: You would have a case were you to be injured by the vehicle which your employer knows to be dangerous. But the workers' compensation remedies are limited and exclusive. I suggest you quit and get another job.
