Q: My lawyer is rude and completely checked out of my personal injury claim..... What can I do?

I was hit by two trucks on my motorcycle waiting at a stoplight in January. I sustained spine injuries and my motorcycle was totaled. I retained an attorney three days after the accident and have yet to have settled the claim. In addition to the lack of sense of urgency my attorney is very unresponsive, and when I do speak with him he is extremely rude and doesn't seem to know a whole lot of the details surrounding my case. What can I do to cover myself?

A: As Mr. Titus points out, you have the right to speak with another attorney. That decision is up to you. But the fact that your case hasn't been settled since January (2019 possibly?) is not necessarily a reflection of poor advocacy. It looks like you may have sustained serious injuries, together with facts that seem to point toward liability in your favor. It could be a case that an attorney does not want to rush in settling, based on seeing what materializes in your medical care. Or it could be a case that based on negotiations, is finding no alternative than litigation. This is only speculation based on the brief facts. Those are simply things to consider. Being happy with an attorney also has its personal elements, so that is something which will ultimately be up to you. Good luck
