Q: Laid off on H1B, found multiple offers in 60 day grace period.
Hi,
I got laid off from employer A with last day being Nov 12.
I recently got an offer from a small consulting firm (Company B) that has filed my H1B transfer in regular processing and has asked me to join the client on 12/23. Today I got a full time offer from company C that MIGHT file H1B transfer within next 2 weeks ( 1 week after I join Company B) in premium processing. They will do it before the grace period ends and I have shared the approved petition of Company A.
Questions:
1. will petition from Company B considered a Bridge for company C? I mean company B's has filed petition before company C and does not have approval. Then does company C need to initiate the transfer based upon company B' receipt or based upon Company A's approved petition from where I was laid off?
2. Can Company C's petition (premium) get approved before Company B's (regular)? If yes, can I ask Company B to withdraw its petition?
3. Can B's and C's petition be approved independently?
A:
Company C can independently file for you for H1-B within the 60 days. That is not related to Company B.
It is certainly possible C is approved prior to B or that B is not approved .So you can have multiple petitions simultaneously .
