A: Depends on whether the Defendant is in custody or out of custody. If the Defendant is in custody its 120 days. If the Defendant is out of custody, its 160 days.

A: 120 days for someone in custody and 160 for someone out on bond. This is all assuming there is no delay attributed to the defendant. This is something that needs to be discussed with their attorney. If the defendant does not have an attorney, one should be hired right away. The sooner an attorney is hired, the better.
