Oaktown, IN asked in Criminal Law for Indiana

Q: 35-48-4-8.3(b)(1)/MC: Possession of Paraphernalia This is what I was charged with. I had a 1 hitter. Do i need to worry

I admitted to having a one hitter when asked to search my car. It was empty. I did not have any drugs or anything else on me. Do I need to worry about going back to jail at my court date? This is my first offense for this

A: It is a Class C Misdemeanor to be in possession of paraphernalia, which carries a possible jail sentence of 60 days. If you do not have an attorney, hire one or request a public defender. Depending on your history you may qualify for a Pre Trial Diversion.
