Q: Q1) Did I overstay in USA? Q2) Will there be any hurdle in my immigrant F4 visa from OPT?

Dear Immigration Lawyer.

I received my OPT in Sept/13/ 2002 and it expired in Sept /12/2003 after completing my study from Baruch College. I had been looking for a job from 2002 to 2003 but I didn't get the breakthrough.

I went back to international student office of Baruch College before a week of expiration of my OPT card. I was advised that" I have 60 days of grace period after the expiration of my OPT to leave the USA".

Then I took the flight on Sept/19/2003 to Pakistan after a week of my expired OPT.

Q1) Did I overstay in USA?

I have been sponsored from my US citizen Sister under immigrant F4 visa and my petition was approved from USCIS. Right now my case is at NVC.

Q2) Will there be any hurdle in my immigrant F4 visa from my stay as Student and OPT card holder?

A: It appears to me that you did not overstay. Even if you did, it should not interfere with your permanent residence case.
