Buffalo, NY asked in Criminal Law and Family Law for New York

Q: roommate stole my dog, then filed restraining order so that I can’t get my dog back? I have proof of all docs/ownership

I have certificate of ownership receipts of purchase emotional support animal Letter, vet bills only my name on it. My sick roommate asked me to date her I been refusing, I was sexually and physically assaulted so I left for a week out of state when I came back she stole my dog. And demanded I become her lover I said no so she’s now trying to be smart and filed restraining order so that I can stop trying to get my dog back. And she left out of state with the dog. Police won’t help they said go do small claims, and I’m in middle of moving out of this state of NY to another state 1200 miles away. Now I’m stuck with having to attend the RO court hearing. I have to drive 10 hours to get to hearing I have all documents proving I was the victim of domestic violence not Her. I’m not worried of restraining order being approved i wanna know how to get my Puppy back if she’s in another state and I’ll be in a 3rd state or where the crime happen which is NY, other than small claims how can I get

A: If she is out of state and you are out of state, the only way go get the dog back is to go to court in the state she now lives in.
