Auburn, GA asked in Family Law, Child Custody, Child Support and Juvenile Law for Georgia

Q: I just found out my children's grandmother filed a petition for dependency against me what is a petition for dependency?

What is a petition for dependency and what should I do ? My children do infact live with her because she begged me to allow them to , but her son is only the father of my oldest child yet he signed off on a birth certificate for my youngest child who isn't his , he also lives with his parents and my minor children . They have begged me to lie and get food stamps in my name so that they could use them (and I was not allowed to have the card nor have I ever been able to use it ) . We agreed that prior to me and my ex splitting up that I claim my children when filing taxes as long as I gave my ex and his mother money out of my tax return/refund which has worked and been fine and dandy for the last 6 almost 7 years until recently when she suddenly stopped answering my phone calls and text messages and refuses to allow me to see or have communication with my children and now I see it is because she has filed for this petition of dependency. What can i do or what should I do ?

A: You need to hire an attorney. A petition for dependency typically alleges that the children have been abandoned or neglected and are without a proper guardian. It can significantly affect your parental rights.

A: She must of filed the petition because she believes the children have been abandoned or not being properly taken care of. You will need to work with an attorney to address this issue. -Homer P. Jordan IV, Esq. 404-620-1558
