Asked in Immigration Law for New York

Q: Can my step-dad cosponsor my wife for green card if he recently divorced my mom?

I want to sponsor my wife for a green card. Because I’m self-employed abroad and have claimed Foreign Earned Income Tax Exclusion, I want to have a co-sponsor so there’s no problems with my application.

However, My “father” I’ve known all my life is my step-father. And he and my mom (who I don’t have contact with) divorced not long ago. Would he be eligible to co-sponsor at all?

For what it’s worth, they were married for 25+ years and I was well into adulthood when they divorced.

A: Yes your step dad can act as a joint sponsor if he is a US citizen or has a green card and makes sufficient income.
