Q: Father is custodial parent. Mom is leaving state during her time. Can father keep the child?
Mom is leaving state the 22nd, back the 30th. The 28th and 29th are her parenting days. She told us she'll be out of state but is planning to let her dad watch their son that weekend. We haven't agreed to anything. Court paperwork does say that grandparents do not have custody, rights, and can not discuss with the other party.
Father plans to just keep the son as mother will not be here for her parenting time.
Is he legally allowed to hold their son?
A: It depends on the language of your agreement as a whole. An attorney would have to read it. It is not clear what you mean when you say that the grandparents do not have custody rights and can not "discuss" with the other party.
