Q: Can a police agency being charges for local income tax?
Filed in Ohio with a regional income tax agency for year 2014.
We were starting payment arrangements on the back taxes.
We were unaware we need them.
The tax agency says they notified the city where the taxes were filed for sometime ago.
The city tax agency notified the city police for criminal misdemeanor charges for my husband for nonpayment of taxes.
In a week, we will be filing bankruptcy.
We did our part filing nd sending notice to both tax office and the city tax office of a payment agreement.
Can they charge him when we filed the tax and payment agreement?
A: A charge of a misdemeanor does not require an indictment by a grand jury. As a result, a local police department can charge your husband with a misdemeanor simply upon the direction of the municipality's tax authority. Your husband needs to promptly retain the services of an attorney with experience with criminal tax cases.
