Q: How can I find out if my sister has power of attorney over my 91 year old grandfather&what kind of POA she may have?
A:
While family may have a natural desire to know what planning documents an elderly relative has in place, those details are private and there is ordinarily no obligation for a grandparent (or other planner) or the person named as attorney-in-fact to reveal the details to any other relative.
An exception arises when someone uses a power of attorney in Maryland to sell real estate. In that case, the power of attorney must be recorded among the Land Records and anyone can look up the Land Records and get a copy of the recorded document.
One can always ask the planner, but again, people are allowed to privately create powers of attorney and they don't ordinarily need to announce the fact to anyone else.
