A: Your best course of action is to consult with an attorney immediately. A baby sitter selling drugs while she was watching the child is a big problem. It seems quite opportunistic that her grandmother would be there to take pictures when this happened. You will need to file something with the Court and there will be a hearing. In Tennessee, the court's follow the best interest of the child analysis to determine custody. It is a multi-factor standard that is fact intensive. Good luck.

A: Ok, that is a little better. If Grandmother got custody, then it was a dependent and neglect petition for which you were entitled to both a preliminary hearing and the appointment of an attorney. You need to follow your attorney's advice.
