Q: Does an expungement in NJ clear or seal my only arrest for simple assault that was dismissed in court?

A: It seals your record from certain parties such as the general public but law enforcement the courts etc and certain governmental agencies can still see it. Sometimes it is actually better on your record to keep the dismissal rather than expunge as this shows your dismissal and you can still get documents to prove it should you lose your certified disposition in the future etc. Of course an attorney makes money doing your expungment so many won't come straight out and tell you this and it varies on your situation on whether it may be best to expunge or not etc thus you should set up a consultation with a lawyer to determine what is best for you, but expect to pay for the consultation with a good honest lawyer.

A: An expungement removes your record of arrest and legally permits you to say "I have never been arrested" and anyone who seeks to use said arrest against you is guilty of a 4th degree crime.
