Q: My exhusband is keeping my kids from me. I was granted sole physical custody in our divorce. How can I get them back?
My divorce was granted in Alabama, I now live in Florida, and my ex lives in Louisiana. I went to the sheriff's department and they said they were unable to help without a warrant. How do I obtain one?
A:
You now have a multi-state problem. I recommend you take the following steps, in order:
1) If the Custody Judgment was from AL, get a certified copy of that Judgment from the Clerk of Court in whatever county granted it,
2) Get a FL lawyer to file a Petition to Recognize a Foreign Judgment,
3) Get your FL lawyer to file a Motion for Contempt and Civil Warrant,
4) Get a LA lawyer to file Letters Rogatory to Execute the FL Civil Warrant,
5) Go to the Sheriff in LA to execute the Civil Warrant.
You have only six months from the date your children went missing.
