Miami Beach, FL asked in Real Estate Law and Landlord - Tenant for Florida

Q: No hot running water

I signed a lease on an apartment in Miami Dade . Lease starting date 3/13/2020. When doing the walk thru I found out there was not hot running water. The realtor I was doing the walk thru with said I could not move in without hot water in the apapartment, she would have it fixed and the starting date on the lease would be adjusted accordingly. Everything was noted in the walk thru sheet with mine and the realtor's signature. Also received an e mail from the realtor mentioning there was no hot running water, it would be repaired shortly and starting date adjusted. I was given the key, paid first, last and deposit with a check wich was cashed a couple of days later. I DID NOT move in. 3 weeks have passed , still not hot water. I e mailed the realtor, she responded saying since I didn't contact her sooner I would have to pay rent on the 13th and the lease starting date would not be moved. Do I have a legitimate right to have the starting date moved to when finally the hot water is fixed?

A: What does the lease say? Does it stipulate that move in date will be after the hot water issue is fixed? Get a copy of your lease and take it to a landlord/tenant attorney to review.
