Q: How can I remove my son's father from birth certificate?

I took him to court. We have shared custody and he is ordered to pay child support. However, he decided to move out of state upon papers being served of custody/support in February 2018. Since the date of judgment, he has only made 2.5 payments and has seen him a total of 2.5 hours in person. He has come down from Texas 2 times without contacting me to see his son. He failed the drug test upon initial determination of custody and supervised visitation. It is set that he is only allowed to see him every other Sunday from 9am-12pm. I am worried about him getting custody if something were to happen to me. My wishes are for my son to go with my mom or brother who can provide for him the same lifestyle, faith and schooling options I have chosen for him. What can I do? I am definitely willing to give up child support obligation in order to remove him from the birth certificate. Please help. He owes over $6,000 in child support and only video calls him for a few minutes when he "has time".

A: You can only remove him from birth certificate if:

1) he fails to pay child support and fails to contact his child for 6 months AND

2) your subsequent spouse wants to adopt.

Hire an adoption lawyer.

But you can still designate a Guardian in your will. Contact an estate planning attorney.
