Conroe, TX asked in Criminal Law and Constitutional Law for Texas

Q: How constitutional are bond restrictions, where you're essentially found guilty until proven innocent?

Defendants are placed on bond restrictions, "parole" until their case ends, charged a fee and have to take UAs and if found innocent, are not reimbursed.

1 Lawyer Answer

A: Constitutionally, the judge has wide discretion to set the amount and conditions of bond. However, none of the bond conditions should require the defendant to confess to illegal behavior... so no Narcotics Anonymous or similar programs.

You have at least two options if you don't like the conditions of bond:

1) Hire an attorney to attempt to convince the judge to vacate or modify the conditions.

2) You could forfeit your bond and return to jail until trial.
