Q: If you brake a hip and spend 3 mins in hospital because someone didn't see me running me over with his truck. My ss

Check was used. To help pay bill. My apartment. Manager wants my back rent with latefee added on. Shouldn't insurance pay that. I have no money to pay.

A: His insurance will not make installment payments to you. It will insist on making one payment that releases and waives all claims that you have. There is no way that you can negotiate this responsibly on your own. You may have significant future medical expenses. Your current treatment might not be complete. You don't know how much your current medical expenses are. It's unclear whether you have lost wages or will do so in the future. It is highly likely that you will undervalue your claim and sign a release for too little money. Get an attorney.

You still have to pay your rent. I know this sounds unfair to you, but that is how it is. Talk to an attorney now.

A: Thank you for clarifying your question. You can delay paying medical bills. Do not use your SS benefits check for medical expenses. Use it to pay rent. Generally, there is no excuse for non-payment of rent, however, you can ask the court to allow you to pay current rent and to pay back rent in installments. There is no guarantee that this will happen but because of the Corona crisis, your landlord will not be able to initiate an eviction for at least the next 30 days. Pay current rent now and hire a lawyer to help you fight the eviction and sue the individual that ran you over. Best of luck.
