Beaverton, OR asked in Landlord - Tenant for Oregon

Q: We signed a 1 year lease which is up in July. We just received a 30 day no reason eviction. Can they do this and is it

Enforceable during the state of Oregon moratorium? We know the person who owned the rental and he says that by law he can not do anything about it. Is this true? The owner worked out a payment plan for the deposit with us. He was going to pay the deposit and we would pay him back. The management company that he uses told him that was not legal. That he could not pay the deposit for us? With the current environment with the virus, I don’t think we can find a place and move in 30 days and do it while keeping my family safe from contracting it.

A: Management companies work for owners so I am not understanding your posting in general. Owners are not required to take security deposits. Regardless, if it is a no cause termination notice it cannot currently be legally issued to you and should be unenforceable as well as it's issuance being a potential criminal misdemeanor. Further, your lease apparently runs through the end of June - and they cannot terminate it before then without just cause. Problems? Consult a landlord-tenant attorney to learn your specific rights and to make a game plan. Good luck.
