Q: Does my child support start the month the divorce is final or the month the separation paperwork filed?

Do I owe back child support once the divorce is final or do I start paying the month the divorce is final.

A: You should consult with your own attorney. Generally in Kentucky divorce agreements are effective as contracts on the day signed. Once the decree is signed and the agreement is incorporated into the judgment, it becomes enforceable and subject to the court’s contempt powers. Your question asks do I have to pay once separation papers are filed? Is this a legal separation? Is there an agreement or will the court decide. Party seeking child support is entitled to retroactive support from the date such support was requested.
