Q: I'm don't know what to do in this situation
Due to COVID-19 I haven't been back to work for about 2 months, I spoke to employer about my present situation which was out of my hands due to problems thats a temporary laid off caused me, employer was not compassionate at all, he acted very contradictory because he call me to let me know that dental office was going to start normal hours by 05/11/2020 and stated that he understands if people stay home due to covid-19 but right after I informed him about my problems he rushed to hang up to finally informe to other employees that I decided not to go back to work.
He made it seen like if i quitted my job which is not truth, I had a problem that did not allow me to go back to work right away but I never said "I'm not going back to work", he did not gave me the opportunity to get to an agreement. That made me think that is not convinient for him to report to DEO that he fired me because that will affect his pocket.
A:
If you have filed for unemployment compensation and are receiving it the DEO might try to cut it off or possibly take back whatever amount received since May 11.
If you have not yet filed for unemployment compensation do not be afraid to do so; many employers are using this pandemic to "thin the herd" so to speak (get rid of some employees).
When you file be sure to tell them that your employer terminated you without cause. Then if the employer objects the issue will go before a claims referee who will hear both sides and make the final decision.
